1. Agreement to Terms

By accessing and using SnapZA ("Platform"), you agree to be bound by these Terms and Conditions. If you do not agree to abide by the above, please do not use this service.

2. Use License

Permission is granted to temporarily download one copy of the materials (information or software) on SnapZA for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

  • Modify or copy the materials
  • Use the materials for any commercial purpose or for any public display
  • Attempt to decompile or reverse engineer any software contained on the Platform
  • Remove any copyright or other proprietary notations from the materials
  • Transfer the materials to another person or "mirror" the materials on any other server
  • Use automated tools, bots, or scrapers to access the Platform
  • Violate any applicable laws or regulations

3. User Accounts and Responsibilities

3.1 Account Creation

To use SnapZA, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and password.

3.2 Age Requirement

You must be at least 18 years old to use SnapZA. By creating an account, you represent and warrant that you meet this age requirement.

3.3 User Responsibilities

You are responsible for:

  • Keeping your password secure and confidential
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account
  • Complying with all applicable laws and regulations

3.4 Accurate Information

You agree to provide accurate information during registration and maintain the accuracy of your profile. False or misleading information may result in account suspension or termination.

4. Acceptable Use Policy

You agree not to use SnapZA for any unlawful purpose or in any way that could damage, disable, or impair the Platform. Prohibited conduct includes:

  • Illegal Activity: Using the Platform for any illegal purpose or activity.
  • Fraud and Deception: Submitting fake photos, misrepresenting information, or engaging in fraudulent transactions.
  • Harassment and Abuse: Harassing, threatening, or abusing other users or SnapZA staff.
  • Intellectual Property Violation: Uploading photos you do not own or have rights to.
  • Malware and Viruses: Uploading or distributing malicious software.
  • Spam: Sending unsolicited messages or spam.
  • Offensive Content: Uploading sexually explicit, violent, or otherwise offensive content.
  • Privacy Violations: Uploading photos containing identifiable individuals without consent.

5. Photo Ownership and Rights

5.1 Contributor Ownership

Contributors retain ownership of photos they upload. By submitting photos to SnapZA, you grant SnapZA and the requesting business a non-exclusive license to use the photos for the specified task purpose.

5.2 Business Rights

Upon approval and payment, businesses receive the right to use submitted photos for their specified business purpose. Businesses may not redistribute or resell photos without explicit permission.

5.3 Content Rights

You represent and warrant that you own or have the necessary rights to all content you upload, including photos, descriptions, and metadata. You are solely responsible for ensuring compliance with copyright, privacy, and other applicable laws.

5.4 Third-Party Rights

If your photos contain identifiable individuals, you must obtain their written consent before uploading. SnapZA is not responsible for copyright or privacy violations committed by users.

6. Payment and Withdrawal

6.1 Payment Processing

SnapZA processes payments through third-party payment providers. By using SnapZA, you agree to the terms and conditions of these payment providers.

6.2 Withdrawal Requests

Withdrawal requests are processed within 5-7 business days. SnapZA is not responsible for delays caused by banks or payment providers.

6.3 Fees

SnapZA may charge fees for certain transactions. All applicable fees will be disclosed before you complete a transaction.

6.4 Refund Policy

Refunds for rejected submissions are not provided. If a business rejects your submission, you do not earn payment for that task.

7. Account Suspension and Termination

7.1 Grounds for Suspension

SnapZA may suspend or terminate your account if you:

  • Violate these Terms and Conditions
  • Engage in fraudulent or illegal activity
  • Submit fake or stolen photos
  • Harass or abuse other users
  • Violate intellectual property rights
  • Repeatedly submit low-quality or non-compliant content

7.2 Suspension Process

SnapZA will attempt to notify you of account suspension and provide an opportunity to appeal. Serious violations may result in immediate termination without notice.

7.3 Data Upon Termination

Upon account termination, your data will be retained in accordance with our Privacy Policy and applicable legal requirements.

8. Disclaimer of Warranties

SnapZA is provided on an "as-is" and "as-available" basis. We make no warranties, express or implied, regarding the Platform, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Platform will be error-free, secure, or uninterrupted.

9. Limitation of Liability

To the fullest extent permitted by law, SnapZA shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or loss of use, even if advised of the possibility of such damages.

In no event shall SnapZA's total liability exceed the amount paid by you in the past 12 months, or R100, whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless SnapZA, its owners, operators, and employees from any claims, damages, or costs arising from your use of the Platform or violation of these Terms and Conditions.

11. Dispute Resolution

Any disputes arising from these Terms and Conditions or your use of SnapZA shall be governed by the laws of South Africa. You agree to submit to the exclusive jurisdiction of the courts of South Africa.

Before initiating legal proceedings, you agree to attempt to resolve disputes through good faith negotiation with SnapZA.

12. Third-Party Links

SnapZA may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of these external sites. Your use of third-party websites is at your own risk and subject to their terms and conditions.

13. Modifications to Terms

SnapZA reserves the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting. Your continued use of the Platform constitutes acceptance of the modified terms.
